I have only read a small portion of the ruling so making judgment calls on Roberts’ decision is most likely premature. But I’m going to anyway. I think Artur Davis probably has the right end of it, that Roberts fell sway to the liberal elite meme about how overturning Obamacare would be activism. This line in Roberts’ decision lends credence to that theory:
It is not our job to protect the people from the consequences of their political choices.
I would agree with that in part. But it is the S.C.’s job to overturn those political choices if they contravene the Constitution. He seems to have forgotten that.
